On Thursday, the Delhi High Court requested the Central Bureau of Investigation (CBI) to respond to the bail petitions of the four co-owners of the basement at the coaching center in Old Rajendra Nagar, Delhi, where three IAS aspirants drowned in July. The basement owners are currently in custody, with a trial court recently denying their bail. The court has noted that the co-owners’ liability arises from their illegal act of allowing the basement to be used as a coaching institute.
The case involves the deaths of three civil services aspirants who drowned in the basement due to severe waterlogging following heavy rains. Justice Dinesh Kumar Sharma, leading the bench, issued a notice to the CBI regarding the bail petitions of Parvinder Singh, Tajinder Singh, Harvinder Singh, and Sarabjit Singh, and requested a response on the matter.
Justice Sharma described the case as “unfortunate” and stressed that it is “not an ordinary case.” The court has directed the CBI to provide “concrete evidence.” The matter is set for further hearing on September 11, 2024. Additionally, the court has asked the father of one of the deceased students to provide a “brief reply” to the bail petitions.
The victims, Shreya Yadav (25) from Uttar Pradesh, Tanya Soni (25) from Telangana, and Naveen Delvin (24) from Kerala, drowned when the basement of the Rau IAS Study Circle coaching center was inundated after heavy rains on the evening of July 27. The case is being investigated under the Indian Penal Code (IPC), including Section 304 (culpable homicide not amounting to murder). The High Court has transferred the investigation from the Delhi Police to the CBI.
The four co-owners have claimed that they were merely the owners of the basement, which was rented out to the coaching center, and thus have no involvement in the incident. Previously, a trial court had rejected their bail plea, citing that the CBI investigation is still in its early stages and the specific roles of the accused need to be determined.
